Contract between the parties: Your contract is with USA Travel Business Opportunities Limited t/a Deal A Trip, acting in the capacity as a booking agent for property owners and suppliers. When making a booking each person within the booking is subject to these booking conditions and you undertake that you have the authority to accept these booking conditions on behalf of everyone in the party for whom the accommodation is booked. This contract is made on the basis of these conditions, which are governed by English Law and the jurisdiction of the courts of England and Wales. If you reside in Northern Ireland or Scotland, the relevant court can deal with any dispute. USA Travel Business Opportunities Limited t/a Deal A Trip has no liability whatsoever for any aspect of the travel arrangements and accepts no responsibility for any loss, personal injury or death howsoever caused, except where caused by our own proven negligence.
Confirmation of Booking: A
booking for a property is definite and reserved once the confirmation has been
sent by us, which will be by e-mail.
Payment: A deposit equal to 20%
of the total rental price is due at the time of booking. Provisional bookings
are not accepted. Full payment is required for bookings within 10 weeks of
check-in date. Balance payments are due 10 weeks prior to the arrival date and
in the event that the balance is not received by the due date we reserve the
right to cancel the booking without further reference.
Payments by credit card: The
high cost of fees imposed upon Deal A Trip and other merchants by the merchant
card companies force us to recover at least part of the costs in accepting card payments. We will add 2.9% to payments by a merchant card. This charge can therefore be
easily avoided by paying by bank transfer or in the case of balance payments by cheque (we do not accept deposit payments by cheque due to the need for expedient reservation processing).
Property Descriptions:
Information provided by property owners and suppliers is carefully checked and
produced in all good faith. However, with the detailed features offered by many
properties if a particular feature should become restricted or curtailed
neither Deal A Trip, the property owners or suppliers accept liability for the
loss of an advertised feature, and this does not give cause for a claim for
refund or compensation. Distances and driving times to properties and other
amenities are for information and guidance only, and are to be treated as such.
Property Occupation: The lead
person making the booking is responsible to ensure that the number of persons
occupying the accommodation does not exceed the maximum number of persons
permitted.
Security Deposit: All Holiday
Rental properties will require a form of security deposit in place, usually in
the range of £150/£300, to cover the cost of any damage, breakages, spillages,
telephone call costs, etc. The simplest method of providing this security is
with a major credit card. Details of the requirement for the property booked
will be supplied by us together with the accommodation voucher and arrival
instructions in good time prior to the arrival date. Where the property owner
or supplier has authorized us to handle this requirement we will provide you
with an indemnity form to complete and return to us for holding on file. If
this is this case, with regard to your booking, you will provide the required
credit card information and give us permission to charge to this credit card
the cost of any damages, losses, breakages, etc, found after your departure.
Where the full cost of any loss or damages cannot be recovered from the credit
card, Deal A Trip will invoice you for the outstanding amount, which will be
due for payment immediately. In the event that you fail to pay any such
shortfall Deal A Trip reserves the right to exercise any legal remedy to pursue
the amount owed. Important note: Your contract with regard to your security
deposit and any subsequent charges is with the Property Owner/s and/or their
Agent; as they are responsible for the check-out and informing us with regard
to any charges that we are required to be made to you. Deal A Trip is not able
to become involved in any dispute that might ensue with regard to this aspect of
your booking, other than at its discretion to act as arbitrator between the
parties if so requested. If the actions of any of the party cause damage to a
property booked with Deal A Trip you agree to fully indemnify Deal A Trip
against any claim, including legal costs made against us on behalf of, or by,
the property owners or supplier.
Price Guarantee: The price
you see is the price you pay. When a confirmation invoice has been issued for a
booking then that price is final. Only in the event of force majeure circumstances do we reserve the right to modify these terms.
Alterations by you: If you decide
to alter any of the material details of your booking after confirmation you
must advise us in writing and we will do our best. Subject to availability (and
possible price variance) we will try to amend any part of your booking on
payment of the following administration fees (per amendment): £25. No amendment
charge will be made for adding extra nights to a booking, providing that an
amendment does not affect the price that was applicable at the time of the
original booking. No changes are permitted once travel has commenced, and there
will be no refund, under any circumstances whatsoever, for unused accommodation
– and any statement to the contrary should be disregarded.
Change of mind: It is the
responsibility of the lead person confirming the booking to ensure that what is
being reserved is precisely what is required, as any subsequent change of
inclination or mind will incur amendment fees or cancellation charges.
Alteration by us: We reserve
the right to alter any accommodation booked to one of similar standard or
upgrade to a superior one at no extra charge. In reality this is a very rare
occurrence and highly unlikely to occur, causes for example might be: sudden
damage to a property, failure of a major feature that would detract from the
customers enjoyment, renovation or nearby disruptive building works, property
being put up for sale, etc. Any alteration that is deemed unavoidable will be
notified to you as soon as possible after we become aware of it.
Cancellation by you: If you
have to cancel any part or all of your booking after confirmation you must
advise us in writing. Prior to 56 days or 8 weeks before the check-in date
deposits paid are non-refundable and non-transferable. Within 56 days (8 weeks
of arrival): 50% cancellation charges apply. Within 42 days (6 weeks of
arrival): 100% cancellation charges apply. You are required to have fully
comprehensive holiday insurance to cover the need for an unexpected situation
to arise that causes cancellation of the trip near to departure date, giving
rise to high cancellation charges, when a claim for recovery of losses can be
made, subject to the terms of the travel policy.
Cancellation by us: Deal A Trip
will be entitled to cancel a booking if the client is more than 7 days in
arrears of balance payment without further reference. Deal A Trip also reserves
the right in exceptional circumstances such as force majeure, to cancel a
booking and refund all monies paid.
Property Owner & Supplier Booking
Conditions: Our property owners and suppliers have their own
booking conditions and you will be bound by these, so far as the relevant owner
or supplier is concerned. These owner or suppliers conditions will also apply
to your contract with us and in the event of any conflict between the suppliers
conditions and our conditions, the owner or supplier conditions will prevail,
save to the extent that any term in the owner or suppliers conditions is deemed
to be invalid or unenforceable, in which event our conditions will prevail.
Some of our owner and supplier conditions may limit or exclude liability on the
part of the relevant owner or supplier and, by virtue of their application to
your contract with us, may also limit or exclude our liability to you, and they
are often subject to international conventions.
Force Majeure: Deal A Trip
accepts no responsibility for, and shall not be liable in respect of, loss or
damage or changes or cancellations, additional costs or expenses incurred, if
it is unable to fulfill its contract, to events caused by force majeure such as
weather conditions, transport problems, strikes, riots, political unrest, war
hostilities or threat of war, terrorist activity, industrial dispute, fire,
flood or any other event of any description or nature that is beyond the
company’s control.
Limit of Liability: Deal A Trip
and its agents, property owners and suppliers do not accept responsibility or
liability for any accident, injury, illness or damage to any person or their
property howsoever caused, nor liability for the failure of services in or on
the grounds of any property. Claims are strictly limited to a maximum of the
rental price invoiced for the individual component service provided and further
claims for any supplementary services (extras) booked; e.g. heated pool,
grocery pack, etc are strictly limited to the amount paid for that extra
service.
Special Requests: We cannot
accept a booking that is conditional upon a special request being met unless it
is confirmed by us in writing. We will gladly pass on any request that is asked
for on the understanding that it is not guaranteed.
Travel Insurance: It is a
condition of booking a property with us that all persons in the party will have
a fully comprehensive travel policy to cover all aspects of the trip to be
undertaken, although the policy can be taken out with a third party.
Passport and Visa: It is your
responsibility to ensure all persons in the party have valid passports, visas,
driving licence and any health requirements, as required for the purposes of
the trip.
Complaints: We have built our
reputation by providing a high standard of service and reliability, and our aim
is to provide you with holiday arrangements based on exactly what you have
booked. However, in the unlikely event that something is not to your
satisfaction you must advise the local agents or responsible parties
immediately. They will do their utmost to resolve the problem, contacting us if
necessary. If, for any reason, you cannot contact the local agents then you
should contact us direct. It is essential that we are notified immediately of
any problem that is not resolved, allowing us every opportunity to rectify the
difficulty whilst you are still in resort; there is nothing we can do once you
have returned home. If you do not follow the above procedure no further
correspondence will be entered into and any letters will be treated as for
information purposes only. NB: For clarification: Any claim for accommodation credit must be made with the actual property supplier 'in resort'.
